Love and the judge

Photo: Peter Braig He has talked Rosetta Stone at length of his landmark legal rulings, now Michael Kirby and his partner of 41 years tell, for the first time, of a love the law is still catching up with. Neil McMahon reports. AS MICHAEL KIRBY knows well, some things add up only with hindsight and even then the future can have other ideas. The law, for instance, can take its time to make sense and still later change its mind. Love is even more fickle. Life is a puzzle and Kirby's life is a case in point. If the sum of it makes sense today, the living of it can appear a journey far less certain. He is 71 now, seemingly serene and therefore more comfortable describing the verities that have sustained him than he is harping on doubts that might once have plagued his peace of mind. There are so many things Kirby says he has never had to question: a loving family that always embraced him; an intellect that rarely failed him; a career that fulfilled him; a quiet but consistent faith in God; and perhaps the defining pillar of his life, a relationship that began 41 years ago, and which thrives today. Kirby is talking about the love of his life, and the secret he slowly surrendered to pursue a grand, lifelong love affair. Advertisement: Story continues below "Pretty heroic," Kirby says with a smile of his relationship with Johan van Vloten. He is describing its length but he might as well be hailing its survival: from its beginnings in a world very different from today's acceptance of gay people; through decades of public secrecy; an unusual coming out when Kirby was on the High Court; a tawdry but baseless political scandal with the couple at its centre; and, finally now, the first detailed public recounting by both men of a love Kirby describes as "my great blessing". Van Vloten has never before spoken publicly. He has been coaxed on to the public stage for an ABC documentary on Kirby's life, to air next Sunday. In it, he at last pairs his voice with his partner's to give viewers an intimate look at their relationship and, surely, the nation's first close-up examination of any gay romance of such duration. As Kirby tells it, when he came out in 1999 via a discreet change to his Who's Who entry it was van Vloten who was the instigator. "He Rosetta Stone Software said we owed it to the younger generation. He wasn't so concerned about the politicians, he was concerned about young people who had gone through a similar life to ourselves." Now, once more, they are cast as teachers of sorts the focus on their relationship again playing its part in changing the way Australians view gay people. In our conversation it is clear Kirby is delighted to publicly celebrate his love and to have van Vloten do it with him. "I'm very proud of him," Kirby says of his partner's TV appearance. But he hopes people come away from this interview and next week's program not celebrating them as something special but recognising the everyday simplicity of a relationship that just happens to be between two men. "In fact," he says, "I think the whole thing is a bit boring, but most human lives are boring. But the boringness of it is a very important message to get over to fellow citizens. It's not the whole of either of us, Johan and me, but it is a great blessing to us." It began in early 1969, when both men were 29. Kirby had just endured the end of his first love affair, with a Spaniard he had met at a gay bar in Sydney. When the Spanish man left town, the young lawyer brushed off a bruised heart and ventured out again. "I remember being at my apartment in Kirribilli and looking out at all the little lights [across the harbour] in Sydney and the eastern suburbs and thinking, 'There must be someone out there.' And then I went in by the ferry." Call it fate. Van Vloten was out for a drink, too. He remembers the night just as clearly, including Kirby's opening conversational gambit: an eccentric dash of German history. The semi-traditional courts
Today it is taboo to talk about Hutus or Tutsis and the push to create a sense of unity on the Rosetta Stone population is visible everywhere. Most importantly, perhaps, Rwanda is stable. In November the country became the newest member of the Commonwealth - only the second country not formerly a British colony to be admitted (after Mozambique). The move came after English became the official language for schools to teach in, ousting French in . The sense of optimism created by the fast-growing economy, reduced corruption and decreasing crime rate has brought Rwandans from neighbouring Uganda and Burundi flooding home. The government seems anxious to make sure that the rapid growth doesn't damage the environment and the country has a head start because of Rwandans' fierce sense of civic pride. On the last Saturday of each month, every citizen over the age of 18 must take part in umuganda, or communal work. Businesses are closed and everyone spends the day improving their neighbourhoods. As a result, Rwanda is remarkably litter free and when our driver, Twalib, suspects I am about to drop a soft-drink can he almost wrestles me to the ground in horror. The road coils around the hills, passing terraced fields and roadside markets with men and women carrying baskets, bushels of banana leaves and even carpets on their heads. Our group of five is accompanied by a guide, trackers and a ranger with a gun to scare away stray buffalo. Many rangers are poachers turned gamekeepers; in a bid to stop people from nearby farms poaching the park's animals, they were given jobs here. Slipping and sliding up the muddy hillside, we walk through eerie bamboo forests and yelp in fields of stinging nettles. The ground beneath us is a tangle of roots and stalks and as difficult to balance on as a cat's cradle. But the views are incredible. In the distance are the jagged edges of three of the volcanoes that give the park its name; below Rosetta Stone Portuguese us the farmland with its black volcanic soil and all around the changing green of the hills.

Now comes Alderman's SexGen suit, which was filed July 3 and seeks unspecified damages. "It's a piece of software and software is copyrightable," Taney said. "It's also expressed in graphics, which also are copyrightable. There is some sizzle. People like to say it's really far out there, but at the end of the day I equate it to basic intellectual property principles." Unlike many popular online worlds, such as "World of Warcraft," Linden Lab grants its users broad rights to create and sell content with few restrictions. Users can install copy protection and seek U.S. copyright and trademark protections, all of which Alderman did for the SexGen software. "Whenever you create a situation where people are buying and selling things and potentially misappropriating them from their rightful owners, it is only a matter of time before the legal system gets called in," said Fred von Lohmann, a senior staff attorney at the Electronic Frontier Foundation in San Francisco. "This seems like a relatively straightforward case. It sounds like there is a real copyright issue." Taney believes he knows who Catteneo is in real life, but is confirming it through subpoenas of records of eBay Inc.'s PayPal payment service as Rosetta Stone Spanish Spain well as chat logs and trade history in "Second Life." He said Linden Lab and PayPal turned over their records, and he is preparing another round of subpoenas. "We're proceeding carefully," Taney said. The legal issues may be similar offline and online, but von Lohmann said the trials could be a lot more interesting. Christopher Dodds, a visual artist, Adam Nash, a musician and 3Dreal-time artist, and Justin Clemens, a writer, all from Melbourne,were last year awarded a $,000 artist-in-residence grant from theAustralia Council to create a work for the online social networkingworld - believed to be the largest grant of its type. Residents of Second Life, represented by theircomputer-generated avatars, can speak or type messages into theinstallation; voice-recognition software converts their words intoletters that fall from the sky to create a tower. There is also an essay by Clemens, which will be available inprinted form (only 100 copies) or online. Dodds has been a resident of Second Life for two years, and setup Info Island so that he and Nash could experiment with graphicsculptures. Dodds's spiky-haired avatar, Mashup Islander, was approachedlast year by an avatar from the Australia Rosetta Stone Language Council who wasresearching Australian artists working in Second Life. "Inside Second Life the user can walk up to these sculptures andinteract with them - get inside them, move around them," Doddssays. "This is the inherent beauty of virtual art - it's possibleto create objects and experiences that aren't possible in the realworld." Nash says another attraction is how work evolves as visitorsmake their contributions. "We'll be watching it to see what emergesand how it grows," he says of Babelswarm. Nash, a performer and composer, began his virtual career withthe group The Men Who Knew Too Much. "We began working shows about 1997 that involved performances invirtual environments," he says. "In those days it was a little lesssophisticated than now. Virtual reality was the buzzword, andpeople talked about living in a 3D fantasy universe." He is full of praise for the Lismore Gallery and its director,Steven Alderton: "It was one of the first to be really interestedin what we were doing and really understood it. It's not common tomeet somebody with a good understanding of the potential." Dodds and Nash are embarking on a new venture, the AustralianCentre of Virtual Art, with the aim of curating virtual art. Mark Harvey's sorrow at toddler's drowning death in Essendon
A lawyer for former Fremantle coach Mark Harvey and his wife today expressed in Rosetta Stone court the couple's sincere condolences to the family of a toddler who drowned in their rented Essendon home three years ago. Lauren Harris was three when she died after her mother Monica Harris found her in the backyard swimming pool in September 2008. Despite attempts to save her, Lauren died later in the Royal Children's Hospital. The Harveys this morning attended the Coroner's Court at the start of an inquest into Lauren's death. Neither were prepared to compromise
It was that last piece of news which caused my father to surrender earlier that he Rosetta Stone Language would otherwise done. It is one of the reasons I welcome the forthcoming ban on sming in any public place. My mother had never smed in her life, but had become the victim of secondary sming through many years as a teacher spent in a sme filled staff room. My mother’s first round of palliative chemotherapy coincided with my father’s last day of consciousness and by great fortune they were next to each other in the cancer unit. I left them holding hands for as long as was Language Learning Software possible. They too were heros, the first of their generation to get to University from a working class background. They were fiercely loyal to each other and to a value system based on trust and respect. Neither were prepared to compromise those values for the sake of personal advancement. In clearing out their various documents I discovered that my mother had not kept any records of my academic achievements, but she had kept the letter from the University expelling me for revolutionary activity. We were reinstated (the University were guilty of a breach of natural justice) but during that period, when many parents would have been on the side of authority, mine provided unfailing support. Now I drew the ideas from various readings
The Times today reported on a research project at the University of Rosetta Stone Portsmouth which has established that the best way to catch a person telling a lie, is to get them to repeat their story backwards. The argument is that it is more stressful to tell a story backwards and more difficult to get things right, unless you are relating real events. The article reminded be of an established Cognitive Edge method, provided further evidence for my concern to separate story telling from narrative patterning and finally frustrated me about research in social systems. For more read on .. Many years ago I created a technique, The Future Backwards, as an alternative to scenario planning based on this principle. Its fairly easy to game scenario planning. You create stories going forwards in time to cover possibilities. Now if you have strong opinions about what should happen, then it is easy to influence the evolution of a scenario that will support your Rosetta Stone Software proposed actions. Its also easy to describe how the past led to the present in such a way as to vindicate your view of history. We found that by getting people to construct history in reverse that they explored more possibilities and were more open to novel discovery. We also found that tracing a future state of heaven or hell backwards to a point in the past, not the present, people opening up a wider range of possible futures and were less possessive about those future time streams than in scenario planning.You can read about the method, and use it without charge (subject to a commons license) using this resource. I find it ironic (and I must admit to envy) that Portsmouth managed to get someone to pay then £136K to discover something already know in another discipline. Its nice to have additional proof, but it also shows up the need for greater trans-disciplinary awareness and research practice.practice.I think this is also a pointed for my strongly made point about the different between story telling and narrative work. To tell a story has a double meaning in english and the negative version is the most common. Far better to gather self-interpreted anecdotal material. I had intended to be home today after a long three weeks that has taken me to Atlanta, Washington, Connecticut, Novia Rosetta Stone Language Scotia and finally Manchester and Llandrindod Wells. My original intent was to hire a car in Manchester and drive through the Welsh Marches to a workshop for various Welsh Local Authorities. From there a four hour drive would take me home. As it worked out I was simply too tired to risk the drive, and I needed time to write and catch up generally on email so I took the train. It was a good decision as I got a solid few hours of work in to Shrewsbury and then on the small single carriage train that plies its way between Shrewsbury and Swansea by way of multiple rural settlements and the odd market town, I fell into conversation with a scientist on his way to a conference on global warming. Overall the experience ended well, but with a less than salubrious overnight Llandrindod Wells is a former Victorian Spa town, fallen on hard times but now a centre for activity in Welsh Government. It stands between the industrial (or rather post industrial) and dominant south with a history of activism and internationalism that encompasses the Chartists and the Spanish Civil War, and the rural, welsh speaking north. A tension ever present in Welsh culture (read Emyr Humphries novels to understand this). I grew up in the north, but, through my mother and most of our active relations identified with the south so I have lived in both, understand both but am not fully a member of either tribe.Given that the last train leaves at 1530 and my workshop ended at 1600 I found a hotel and booked a room for the night. Cereal was available but the milk had been out in an open jug next to the overheating toaster for the last two hours. The "full breakfast" ha largely been decanted from tins and burnt. Coffee still had the granules from the nescafe jar floating in the pot. I fled for the station and the train French Learning Software to Swansea.From that point on I did not regret my choice to return by public transport in daylight. I had forgotten just how beautiful mid Wales is.
